Who Qualifies?

✅ First-Time Abatement (FTA): If you have a clean filing history for the past three years, the IRS may remove a late-filing, late-payment, or late-deposit penalty as a one-time courtesy.
✅ Reasonable Cause: You tried to follow the rules but circumstances outside your control got in the way — e.g., serious illness, natural disaster, records destroyed, or a death in the immediate family. Documentation helps.
❌ If you’re not current on all required filings or repeatedly filed or paid late without a compelling reason.

Example: You were hospitalized for surgery during the filing deadline and could not file your return on time.

Example: You received a written IRS notice incorrectly stating you had no balance due, and you relied on that information.
These must be clearly backed by documentation.
By phone: Call the IRS toll-free number on your notice. First-Time Penalty Abatement (FTA) is often granted directly; If you’re requesting relief for Reasonable Cause, the IRS agent may review your explanation and let you know what documentation they’ll need.
In writing: Complete and submit Form 843 Claim for Refund and Request for Abatement with supporting documentation.
This can take several months, especially for written submissions.
No — penalty abatement only reduces or removes the IRS penalties (and sometimes the interest tied to those penalties). It does not erase the actual tax you owe. You’re still responsible for paying the core tax balance. And because the tax itself is still owed, late-payment penalties can start building again on whatever is left unpaid — which is why clearing or arranging payment for the balance matters.
