Frequently Asked Questions

How many years of unfiled tax returns do I need to file?

In most cases, the IRS asks for the last six years of returns to get you back into compliance. That six-year norm is IRS policy, not a legal limit, so the IRS can ask for more in unusual cases.

The right number for you depends on your history, which we confirm from your IRS transcripts before filing anything.

What if the IRS already filed a return for me?

That's called a substitute for return (SFR). The IRS builds it from income reports alone, so it leaves out most deductions and credits and usually overstates what you owe.

In most cases you can still file your own return for that year and replace the inflated bill with the real number. The sooner you act, the less penalty and interest builds on the wrong balance.

How do I file past due tax returns?

Gather your income records (like W-2s or 1099s) from past years. Request transcripts from the IRS if needed. Use the original year's tax forms and submit them by mail or e-file if possible.

Can I still get a refund from unfiled returns?

Yes, but you generally have 3 years from the original due date to file and claim a refund. After that, the money is forfeited. If you owed taxes instead, there's no time limit to file, but the bill keeps growing with penalties and interest until you do.

Could I face jail time for not filing?

It's rare. Most unfiled-return cases are handled with civil penalties, not criminal charges.

Willfully not filing is technically a crime, though, and the risk grows if the amounts are large or the non-filing looks deliberate.

There is also a practical cost: the IRS can file a substitute return for you with steep penalties, making your bill much higher than it should be. Filing before the IRS comes to you is the safest move.
